باستخدامك تطبيق بلسم أنت توافق على هذه الشروط. إذا لم توافق، يرجى عدم استعمال التطبيق.

١. طبيعة الخدمة

بلسم منصّة وساطة تقنية تربط المرضى بمزوّدي الرعاية المرخّصين، وتوفّر للمريض الخدمات التالية:

الرعاية المنزلية: خدمات تمريض وإسعافات أولية في منزلك من كادر موثّق ومعتمد.
الأطباء: حجز مواعيد العيادات + الخدمات المنزلية.
المختبرات: حجز الفحوصات المخبرية ومتابعة نتائجها.
أدوات صحية معلوماتية: متابعة الحمل وجدول لقاحات الأطفال — للمتابعة فقط.
بطاقة الطوارئ (SOS): عرض بياناتك الحيوية عند الحاجة.
إدارة الملف الصحي لك ولعائلتك، وسجل الزيارات.
المحادثة داخل التطبيق مع مزوّد الخدمة المرتبط بطلبك.
الإحالات والمكافآت وأكواد الخصم.

⚠️ حدود الخدمة: بلسم وسيطٌ تقنيٌّ لا يقدّم الخدمة الطبية بنفسه ولا يبيع للمريض منتجاً. وأنظمةُ سطح المكتب أدواتُ عملٍ داخليّةٌ لمنشآت مرخّصة: الصيدلية نظامُ نقطةِ بيعٍ (كاشير) وإدارةِ مبيعات، العيادة نظامُ إدارةِ حجوزات الطبيب، المختبر نظامُ إدارةِ مختبر.

⚠️ تنبيه طبي: بلسم ليس بديلاً عن الإسعاف ولا يقدّم تشخيصاً طبياً مباشراً. الأدوات الصحية (متابعة الحمل، لقاحات الأطفال، بطاقة الطوارئ) ذات طابع معلوماتي وتنظيمي فقط، وليست نصيحة طبية ولا تشخيصاً، ولا نضمن دقّتها أو اكتمالها — راجع دائماً مختصاً. وزر الطوارئ (SOS) ليس بديلاً عن خدمات الإسعاف؛ للحالات الطارئة اتصل فوراً برقم الطوارئ المحلي (١٢٢ في العراق، ٩١١ في غيرها).

٢. أهلية الاستخدام

يجب أن يكون عمرك ١٨ سنة فأكثر.
الكادر الطبي / الأطباء / الصيادلة: يجب توثيق مؤهلاتهم. التطبيق يفحص الوثائق قبل التفعيل.
المعلومات المُقدَّمة عند التسجيل يجب أن تكون صحيحة وكاملة. التزوير = إيقاف فوري للحساب.

٣. حسابك ومسؤوليتك

أنت مسؤول عن سرّية رمز الدخول الذي يصل إلى هاتفك، وعن أمان رقم هاتفك نفسه. ولن يطلب منك موظّفونا ذلك الرمزَ أبداً.
أي نشاط يتم من حسابك يُعتبر منك (إلا إذا أبلغتنا فوراً عن خرق).
ممنوع: مشاركة الحساب، إنشاء حسابات وهمية، انتحال شخصية، استعمال bots.

٤. سلوك المستخدم

ممنوع منعاً باتاً:

إرسال محتوى يحرّض على العنف أو الكراهية أو التمييز.
إرسال spam أو phishing.
محاولة اختراق التطبيق أو خوادمه.
استعمال التطبيق لـ scraping أو أتمتة غير مصرَّح بها.
نشر بيانات شخصية لأشخاص آخرين بدون إذنهم (تطبيق طبي = خصوصية مزدوجة).

المخالفون يُحظرون فوراً ودون سابق إنذار.

المحتوى داخل المحادثات: الرسائل والصور التي تتبادلها داخل التطبيق مسؤوليتك. لا نتسامح مع المحتوى المسيء أو المخالف، ويمكنك الإبلاغ عن أي رسالة مسيئة أو حظر المستخدم المخالف؛ ونحتفظ بحق إزالة المحتوى المخالف وإيقاف صاحبه.

٥. الخدمات المالية

المدفوعات تتم بين المستخدم ومزوّد الخدمة (الطبيب/الصيدلية/الكادر). بلسم ليست وسيطاً مالياً.
العمولات تُحسب لكل طلب وفق نسب موثقة على الموقع.
الاسترداد: حسب اتفاق مع مزود الخدمة.

٥أ. الصيدليات (Pharmacy Accounts)

إذا كنت تستعمل بلسم كحساب صيدلية، تلتزم بالإضافة إلى الشروط العامة بالتالي:

تقديم وثائق ترخيص صيدلية سارية وصحيحة. أي تزوير في الوثائق يؤدي إلى إغلاق الحساب وإحالة المخالفة للسلطات المختصة.
الاحتفاظ بـ سجل المواد الخاضعة للرقابة (Controlled Substance Log) وفق قوانين مزاولة المهنة المحلية. بلسم توفر أداة لتسجيل العمليات ولكن المسؤولية القانونية النهائية على الصيدلاني المرخّص.
سجلات الفواتير والمبيعات تُحفَظ في النظام لأغراض المحاسبة. لا يمكن حذف الفواتير المُصدَرَة (يمكن إلغاؤها بإصدار قيود تعديل فقط).
استعمال أرصدة العملاء (Credit Balance) بـ IQD يخضع للأنظمة المحاسبية المحلية. بلسم ليست طرفاً في الديون بين الصيدلية والعميل.
عدم استعمال بيانات العملاء لأغراض تسويقية خارج نطاق الصيدلية إلا بموافقة العميل.

٦. حقوق الملكية الفكرية

اسم «بلسم» وشعاره وكل المحتوى التصميمي في التطبيق والموقع مملوكة لـمطوّر التطبيق ومالكه، وهو نفسه صاحب حساب النشر في المتاجر ومالك نطاق balsam.online. أي استعمال بدون إذن يُعتبر مخالفة قانونية.

٧. حدود المسؤولية

بلسم بنية ربط — مسؤولية الجودة الطبية على مزودي الخدمة المرخّصين.
نسعى لـ ٩٩.٥٪ uptime لكن لا نضمن استمرارية مطلقة.
لا نتحمّل الأضرار غير المباشرة أو فقدان الأرباح.

٨. إنهاء الخدمة

يمكنك حذف حسابك في أي وقت من إعدادات التطبيق.
نحتفظ بحق إيقاف أي حساب يخالف الشروط، مع إخطار المستخدم بالأسباب (إن أمكن).

٩. القانون الواجب التطبيق

تخضع هذه الشروط لقوانين جمهورية العراق. أي نزاع يُحَلّ في محاكم بغداد.

١٠. الترخيص عبر App Store

أطرافُ هذه الاتّفاقيّة: هذه الاتّفاقيّة بينك وبين بلسم وحدَنا — وليست مع Apple. وبلسم وحدَه مسؤولٌ عن التطبيق ومحتواه.

نطاقُ الترخيص: يُمنح ترخيصٌ شخصيٌّ غيرُ قابلٍ للنقل لاستعمال التطبيق على أجهزة Apple التي تملكها أو تتحكّم بها، وفق قواعد الاستعمال في شروط خدمات Apple.

الصيانةُ والدعم: بلسم وحدَه مسؤولٌ عن الصيانة والدعم الفنّي، ولا تتحمّل Apple أيَّ التزامٍ بذلك.

الضمانُ والمطالبات: بلسم وحدَه مسؤولٌ عن أيّ ضمان، وعن أيّ مطالبةٍ تتعلّق بالتطبيق — مسؤوليّةَ منتجٍ أو مخالفةَ نظامٍ أو حمايةَ مستهلكٍ أو خصوصيّة — وعن أيّ ادّعاءٍ بانتهاك ملكيّةٍ فكريّة. وإن لم يُطابق التطبيقُ ضمانَه، جاز لك إبلاغُ Apple لتردَّ ثمنَ الشراء إن وُجد، ولا التزامَ عليها بعد ذلك.

الامتثالُ القانونيّ: تُقرّ بأنّك لست في دولةٍ خاضعةٍ لحظرٍ أمريكيّ، ولست مُدرجاً على قوائم الأطراف المحظورة.

طرفٌ ثالثٌ مستفيد: تُعدّ Apple وشركاتُها التابعة أطرافاً ثالثةً مستفيدةً من هذه الاتّفاقيّة، ولها حقُّ إنفاذها تجاهك بصفتها مستفيداً منها.

By using the Balsam application you agree to these terms. If you do not agree, please do not use the application.

1. Nature of the Service

Balsam is a technical intermediary platform that connects patients with licensed care providers, and offers patients the following:

Home care: nursing and first-aid services at your home by verified, accredited staff.
Doctors: clinic appointment booking and home services.
Laboratories: booking lab tests and following their results.
Informational health tools: pregnancy tracking and a childhood vaccination schedule — for tracking only.
Emergency card (SOS): displaying your vital information when needed.
Health record management for you and your family, with a history of visits.
In-app chat with the provider attached to your request.
Referrals, rewards and discount codes.

⚠️ Scope of the service: Balsam is a technical intermediary. It does not deliver the medical service itself and sells the patient no product. The desktop systems are internal tools for licensed businesses: the pharmacy system is a point-of-sale (cashier) and sales-management tool, the clinic system manages the doctor’s appointments, and the laboratory system manages lab operations.

⚠️ Medical notice: Balsam is not a substitute for emergency services and does not provide direct medical diagnosis. The health tools (pregnancy tracking, childhood vaccinations, emergency card) are informational and organisational only. They are not medical advice or diagnosis, and we do not guarantee their accuracy or completeness — always consult a qualified professional. The SOS button is not a substitute for emergency medical services; in an emergency call your local emergency number immediately (122 in Iraq, 911 elsewhere).

2. Eligibility

You must be 18 years of age or older.
Medical staff, doctors, and pharmacists: their qualifications must be documented. The application reviews the documents before activation.
Information provided at registration must be accurate and complete. Falsification results in immediate account suspension.

3. Your Account and Responsibility

You are responsible for keeping the one-time code sent to your phone confidential, and for the security of the phone number itself. Our staff will never ask you for that code.
Any activity carried out from your account is considered yours, unless you notify us of a breach immediately.
Prohibited: sharing an account, creating fake accounts, impersonation, and the use of bots.

4. User Conduct

The following are strictly prohibited:

Sending content that incites violence, hatred, or discrimination.
Sending spam or phishing.
Attempting to breach the application or its servers.
Using the application for scraping or unauthorised automation.
Publishing another person's personal data without their permission (a medical application means double the privacy duty).

Violators are banned immediately and without prior notice.

Content inside chats: the messages and images you exchange in the application are your responsibility. We have zero tolerance for abusive or infringing content: you may report any abusive message or block the offending user, and we reserve the right to remove infringing content and suspend its author.

5. Financial Matters

Payments take place between the user and the service provider (doctor, pharmacy, or staff member). Balsam is not a financial intermediary.
Commissions are calculated per request according to the rates documented on the website.
Refunds: as agreed with the service provider.

5a. Pharmacy Accounts

If you use Balsam as a pharmacy account, you additionally undertake the following alongside the general terms:

To provide valid and genuine pharmacy licence documents. Any falsification leads to closure of the account and referral of the violation to the competent authorities.
To maintain a Controlled Substance Log in accordance with local pharmaceutical law. Balsam provides a tool for recording transactions, but ultimate legal responsibility rests with the licensed pharmacist.
Invoice and sales records are retained in the system for accounting purposes. Issued invoices cannot be deleted; they may only be reversed by issuing adjusting entries.
The use of customer credit balances in IQD is subject to local accounting regulations. Balsam is not a party to debts between the pharmacy and the customer.
Not to use customer data for marketing purposes outside the scope of the pharmacy without the customer's consent.

6. Intellectual Property

The name “Balsam”, its logo, and all design content in the app and on the website are owned by the app’s developer and owner, who is the same person that holds the store publishing account and owns the balsam.online domain. Any use without permission is a legal violation.

7. Limitation of Liability

Balsam is connective infrastructure — responsibility for medical quality rests with the licensed service providers.
We aim for 99.5% uptime but do not guarantee absolute continuity.
We are not liable for indirect damages or loss of profits.

8. Termination

You may delete your account at any time from the app settings.
We reserve the right to suspend any account that violates these terms, notifying the user of the reasons where possible.

9. Applicable Law

These terms are governed by the laws of the Republic of Iraq. Any dispute shall be resolved in the courts of Baghdad.

10. App Store Licence Terms

Parties to this agreement: this agreement is between you and Balsam only — not with Apple. Balsam alone is responsible for the application and its content.

Scope of licence: you are granted a personal, non-transferable licence to use the application on Apple-branded products that you own or control, in accordance with the Usage Rules in the Apple Media Services Terms.

Maintenance and support: Balsam alone is responsible for maintenance and technical support; Apple has no obligation whatsoever in that regard.

Warranty and claims: Balsam alone is responsible for any warranty and for any claim relating to the application — product liability, legal or regulatory non-compliance, consumer protection, or privacy — and for any intellectual-property infringement claim. If the application fails to conform to its warranty, you may notify Apple, which will refund the purchase price if any; Apple has no further obligation.

Legal compliance: you represent that you are not located in a country subject to a U.S. embargo, and that you are not listed on any prohibited-parties list.

Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this agreement and have the right to enforce it against you as such.
