هذه الشروط اتفاقٌ ملزِم بينك وبين بلسم (ويُقصد بـ«بلسم» و«نحن» فيها مالكُ خدمة بلسم ومشغّلُها). بإنشائك حساباً أو استعمالك
التطبيق أو أيّ نظامٍ من أنظمته فإنك توافق عليها وعلى
سياسة الخصوصية. وإن لم توافق فلا تستعمل الخدمة.
١. طبيعة الخدمة وحدودها
بلسم منصّةٌ تقنيّة تربط المرضى بمزوّدي رعايةٍ صحية مرخّصين، وتتيح للمريض:
- حجز مواعيد العيادات ومتابعة الدور.
- طلب خدمات الرعاية والتمريض المنزلية من كادرٍ موثَّق.
- طلب الفحوصات المخبرية في المختبر أو بالسحب المنزلي، واستلام نتائجها.
- عرض الوصفات التي يكتبها له طبيبُه، وصرفها حضورياً من صيدليةٍ مرخّصة.
- ملفاً صحياً له ولعائلته، وأدواتٍ صحية معلوماتية، وبطاقة طوارئ، ومحادثةً مع مزوّد الخدمة.
ويتيح للمزوّدين أنظمةً لإدارة أعمالهم: نظامَ العيادة، ونظامَ الصيدلية (نقطة بيعٍ
ومخزون)، ونظامَ المختبر.
بلسم ليس مقدّمَ رعايةٍ صحية: لا يشخّص، ولا يصف، ولا يعالج، ولا يبيع الأدوية
ولا يصرفها ولا يوصلها، ولا يقبض أثمانها. الرعاية الطبية يقدّمها المزوّدون المرخّصون
وتحت مسؤوليتهم المهنية والقانونية، ولا تنشأ بينك وبين بلسم علاقةُ طبيبٍ بمريض. وبلسم ليس خدمة طوارئ — في الحالات
الطارئة اتصل فوراً بالإسعاف (١٢٢ في العراق).
٢. الأهلية والحساب
- يجب أن يكون عمرك ١٨ سنة فأكثر لإنشاء حساب.
- الدخول برقم هاتفك ورمزٍ لمرّةٍ واحدة. أنت مسؤولٌ عن هاتفك وعن سرّية الرمز، ولن
يطلبه منك موظّفونا أبداً. وكلّ نشاطٍ من حسابك يُنسب إليك ما لم تبلغنا فوراً بخرقه.
- يجب أن تكون البيانات التي تقدّمها صحيحةً وكاملة. ويُمنع إنشاء حساباتٍ وهمية أو
انتحال شخصية غيرك أو مشاركة الحساب.
- لا يُفعَّل حساب طبيبٍ أو صيدليةٍ أو مختبرٍ أو كادرٍ إلّا بعد التحقّق من وثائقه
وترخيصه، ويُوقف إن ثبت تزويرها أو انتهت صلاحيتها.
٣. الوصفات الطبية والأدوية
أ. إصدار الوصفة
- لا يصدر الوصفةَ إلّا طبيبٌ مرخَّص من حسابه في بلسم، بعد معاينة المريض
أو بناءً على زيارةٍ معه، وتحت مسؤوليته المهنية.
- الطبيب وحده يحدّد الدواء، وشكله، وجرعته، وعدد مرّات تناوله، ومدّة
العلاج، وطريقة الاستعمال، وصلاحية الوصفة، وعدد مرّات صرفها والمدّة بينها.
- يعرض النظام على الطبيب تحذيراتِ سلامةٍ (تفاعلاتٌ دوائية، حساسيّاتٌ مسجّلة) للمساعدة
فقط؛ والقرار السريريّ للطبيب.
- بلسم لا يكتب الوصفات ولا يعدّلها ولا يقترح أدويةً على المريض.
ب. التزامات المريض
- استعمل الدواء كما حدّده طبيبك تماماً، ولا تغيّر الجرعة أو المدّة دون
استشارته. وراجعه عند أيّ عرضٍ جانبيّ.
- رمز الوصفة (QR) شخصيٌّ: لا تُبرزه إلّا للصيدلي الذي تصرف منه، ولا تشاركه مع غيرك.
- يُمنع تعديل الوصفة أو تزويرها أو محاولة صرفها أكثر ممّا سمح به الطبيب أو صرفها لغير
صاحبها. وكلّ ذلك يؤدّي إلى إيقاف الحساب، وقد يُبلَّغ الجهات المختصّة.
- أخبر طبيبك والصيدلي بحساسيّاتك وأدويتك الأخرى، وحدّث ملفّك الصحي.
ج. الصرف
- الصرف حضوريٌّ فقط في صيدليةٍ مرخّصة مسجّلة في بلسم، بعد أن يمسح الصيدلي
رمز الوصفة ويتحقّق من هويّة المريض أو مرافقه.
- يجوز للصيدلي أن يصرف الوصفة كاملةً أو جزءاً منها حسب توفّر الدواء، ويبقى الباقي
قابلاً للصرف من صيدليةٍ أخرى ضمن صلاحية الوصفة.
- للصيدلي أن يمتنع عن الصرف إن شكّ في صحّة الوصفة أو هويّة المريض أو وجد خطراً دوائياً،
وصرفُ وصفةٍ عليها تحذيرٌ خطير لا يتمّ إلّا بسببٍ مكتوبٍ يُسجَّل.
- ثمن الدواء يُدفع للصيدلية مباشرةً، وبلسم ليس طرفاً في البيع.
د. الأدوية الخاضعة للرقابة
- لا تُكرَّر، وتنتهي صلاحية وصفتها بعد ١٤ يوماً، ولا تُصرف إلّا مقترنةً بفاتورة بيع
وبتسجيلٍ في سجلّ المواد الخاضعة للرقابة لدى الصيدلية (ومنه اسم المريض ورقم بطاقته).
- إساءة استعمالها أو الاتّجار بها جريمةٌ يعاقب عليها القانون، ونتعاون مع الجهات
المختصّة عند الطلب الرسمي.
٤. الفحوصات المخبرية والسحب المنزلي
- يحدّد المختبر الفحوصات المتاحة وأسعارها وأجور السحب المنزلي، وتُعرض عليك قبل الطلب.
- عند السحب المنزلي يزورك ساحبٌ يكلّفه المختبر، ويظهر لك اسمه ورقمه. لا تسلّم العيّنة
ولا تملِ رمز التأكيد إلّا للساحب الظاهر في طلبك.
- رمز التأكيد يثبت أنّ العيّنة سُحبت منك. وتكرار إدخاله خطأً يُلغيه ويولّد رمزاً جديداً.
- ما تدفعه للساحب نقداً يُسجَّل في طلبك ويُحتسب في فاتورة المختبر.
- النتائج مسؤولية المختبر وتُعتمد من مختصٍّ فيه، وتفسيرها لطبيبك.
٥. الحجوزات والرعاية المنزلية والإلغاء
- تسري سياسة الإلغاء والتأخير المعروضة عند الحجز. وقد يترتّب على الإلغاء المتأخّر رسمٌ
يُعرض عليك قبل تأكيده، وعلى عدم الحضور المتكرّر قيودٌ على حجوزاتك القادمة.
- مواعيد العيادة تقديرية، والأولوية للدور الفعلي في العيادة.
- في الرعاية المنزلية يجب أن يكون العنوان صحيحاً وأن يتوفّر شخصٌ بالغ عند الزيارة.
ويُمنع الاعتداء على الكادر أو إساءة معاملته.
٦. المدفوعات والخصومات والنقاط
- تُدفع أثمان الخدمات والأدوية مباشرةً لمزوّد الخدمة (نقداً)، ولا يقبض بلسم
أيَّ مبلغٍ من المريض ولا يحفظ بطاقات الدفع.
- أكواد الخصم ونقاط الولاء والمكافآت ورصيد المحفظة (يُمنح تعويضاً أو مكافأةً فقط، ولا
يُشحن بالمال) ليست لها قيمةٌ نقدية، ولا تُحوَّل إلى مال، ويجوز تعديلها أو إيقافها، وتسقط عند
إساءة استعمالها.
- الاسترداد والخلاف على المبالغ بينك وبين المزوّد، ونساعد في حلّه عبر الدعم.
- لا تُجرى أيّ عمليّة شراءٍ أو دفعٍ داخل التطبيق: الخدمات تُقدَّم حضورياً وتُدفع للمزوّد مباشرةً.
- يدفع المزوّدون لبلسم اشتراكاتٍ أو عمولاتٍ وفق ما يُتّفق عليه معهم، خارج التطبيق، ولا تُحمَّل على المريض.
٧. السلوك والمحادثات والتقييمات
- يُمنع المحتوى المسيء أو المحرِّض أو المضلِّل، والرسائل المزعجة، ونشر بيانات الآخرين
دون إذنهم، ومحاولة اختراق التطبيق أو أتمتة استعماله.
- المحادثات مخصّصة لتنسيق الخدمة، وليست بديلاً عن المعاينة الطبية.
- التقييم يكون عن تجربةٍ حقيقية، ويُمنع التقييم الكاذب أو المأجور. ويحقّ للمزوّد الردّ،
ونحذف ما يخالف هذه الشروط.
- يمكنك الإبلاغ عن أيّ رسالةٍ أو مستخدمٍ مسيء، ونتخذ الإجراء المناسب.
٨. التزامات مزوّدي الرعاية
- الحفاظ على ترخيصٍ مهنيٍّ ساري المفعول، وتقديم وثائق صحيحة، وتحديثها عند تجدّدها.
- تقديم الرعاية وفق الأصول المهنية والقوانين النافذة، وتحمّل المسؤولية المهنية الكاملة
عمّا يُدخلونه من تشخيصٍ أو وصفةٍ أو نتيجة.
- الحفاظ على سرّية بيانات المرضى، وعدم استعمالها إلّا لرعايتهم، وعدم نسخها أو نقلها
خارج بلسم إلّا بحكم القانون.
- عدم مشاركة حساباتهم، وإبلاغنا فوراً بأيّ استعمالٍ غير مصرَّح به.
٩. الصيدليات
- تقديم ترخيص صيدليةٍ ساري المفعول، ويُغلق الحساب ويُحال المخالف إلى الجهات المختصّة
إن ثبت تزويره.
- التحقّق من صحّة الوصفة وهويّة المريض قبل الصرف، واتّباع ما حدّده الطبيب، وتطبيق
قواعد الأدوية الخاضعة للرقابة.
- مسك سجلّ المواد الخاضعة للرقابة وفق قوانين المهنة. يوفّر بلسم الأداة، والمسؤولية
القانونية على الصيدلي المرخَّص.
- الفواتير المُصدَرة لا تُحذف وإنما تُصحَّح بقيودٍ معاكسة. والأرصدة الآجلة بين الصيدلية
وزبونها، وبلسم ليس طرفاً فيها.
- عدم استعمال بيانات الزبائن للتسويق خارج نطاق الصيدلية إلّا بموافقتهم.
١٠. المختبرات والساحبون
- المختبر مسؤولٌ عن جودة الفحص، وصحّة النتيجة واعتمادها، وسلامة العيّنة من السحب حتى التحليل.
- المختبر مسؤولٌ عن اختيار ساحبيه وأهليّتهم، وعن تسوية حساباتهم وأجورهم.
- الساحب يعمل في الميدان فقط، ويلتزم بالتحقّق من هويّة المريض برمز التأكيد، وبتسليم
النقد الذي يقبضه للمختبر.
١١. الطوارئ والأدوات الصحية
- زرّ الطوارئ يرسل موقعك ورسالتك إلى فريق دعم بلسم ليحاول مساعدتك، ولا يغني عن
الاتصال بالإسعاف ولا يضمن وصول المساعدة في وقتٍ محدّد.
- متابعة الحمل ولقاحات الأطفال وبطاقة الطوارئ أدواتٌ تنظيمية ومعلوماتية، ليست نصيحةً
طبية ولا تشخيصاً. راجع مختصّاً دائماً.
١٢. الملكية الفكرية
اسم «بلسم» وشعاره وتصميم التطبيق والموقع وبرمجياتهما مملوكةٌ لمالك بلسم. يُمنح لك ترخيصٌ
شخصيٌّ محدود غير حصريٍّ وغير قابلٍ للنقل لاستعمال التطبيق لأغراضه، ويُمنع نسخه أو تعديله
أو الهندسة العكسية له أو استعمال علامته دون إذنٍ مكتوب.
١٣. إخلاء المسؤولية وحدودها
- ليس نصيحةً طبية: ما في التطبيق من معلوماتٍ — ومنه تحذيرات السلامة الدوائية
والتذكيرات والأدوات الصحية — للتنظيم والمعلومة فقط، ولا يغني عن استشارة الطبيب. استشر طبيبك قبل
أيّ قرارٍ طبيّ، ولا تؤخّر طلب الرعاية أو تتركها بسبب شيءٍ قرأته في التطبيق.
- المسؤولية عن الرعاية الطبية والتشخيص والوصفات والصرف ونتائج الفحوص على المزوّدين المرخّصين.
- المزوّدون مستقلّون: الأطباء والصيدليات والمختبرات والكادر يعملون باستقلالٍ مهنيّ،
وليسوا موظّفين لدى بلسم ولا وكلاء عنه. والتحقّق من وثائقهم عند التفعيل لا يعني ضماناً لجودة
خدماتهم أو أسعارها أو توفّرها أو نتائجها.
- الخدمة «كما هي» و«حسب توفّرها»: نبذل جهدنا لاستمرارها ودقّتها، دون ضمانٍ صريحٍ
أو ضمنيٍّ لخلوّها من الانقطاع أو الأخطاء أو لملاءمتها لغرضٍ بعينه، في الحدود التي يسمح بها القانون.
- لا نتحمّل مسؤولية خدمات الأطراف الثالثة التي تنتقل إليها من التطبيق (كالخرائط وواتساب والاتصال
الهاتفي)، ولا تأخّرَ الرسائل أو الإشعارات أو إخفاقَها لأسبابٍ خارج سيطرتنا.
- القوّة القاهرة: لا نُسأل عن تأخّرٍ أو إخفاقٍ سببه ظرفٌ خارج سيطرتنا المعقولة،
كالكوارث وانقطاع الكهرباء أو الإنترنت العامّ وأعطال مزوّدي الاستضافة والاتصالات والقرارات الرسمية.
- لا نتحمّل الأضرار غير المباشرة أو التبعية أو فوات الربح، في الحدود التي يسمح بها القانون.
- التعويض: يلتزم المزوّد بتعويض بلسم عن أيّ مطالبةٍ أو ضررٍ ينشأ عن خدمته المهنية
أو عن مخالفته هذه الشروط أو القانون، ويلتزم كلُّ مستخدمٍ بذلك عمّا ينشأ عن مخالفته المتعمَّدة لها،
في الحدود التي يسمح بها القانون.
- لا يحدّ شيءٌ في هذه الشروط من حقوقك التي يكفلها قانون حماية المستهلك ولا يجوز التنازل عنها، ولا
يُعفي أحداً من مسؤوليته عن الغشّ أو الخطأ الجسيم.
١٤. الإيقاف وحذف الحساب
- يمكنك حذف حسابك في أيّ وقت من داخل التطبيق (حسابي ← حذف الحساب) أو من
صفحة حذف الحساب: يُجمَّد حسابك فوراً، ويُحذف نهائياً بعد ٣٠ يوماً
ما لم تسترجعه بتسجيل الدخول و«استرجاع حسابي»، وفق ما في سياسة الخصوصية.
- يحقّ لنا إيقاف أيّ حسابٍ أو تقييده عند مخالفة هذه الشروط أو القانون، أو لحماية المرضى،
مع إخطار صاحبه بالسبب متى أمكن.
١٥. تعديل الشروط
قد نعدّل هذه الشروط، ونُعلن التعديل الجوهري داخل التطبيق قبل سريانه بـ ٣٠ يوماً.
واستمرارك في الاستعمال بعد سريانه قبولٌ له.
١٦. القانون الواجب التطبيق وأحكامٌ عامّة
تخضع هذه الشروط لقوانين جمهورية العراق، وتختصّ محاكم بغداد بأيّ نزاعٍ ينشأ
عنها، دون إخلالٍ بحقّك في اللجوء إلى الجهات الرقابية المختصّة.
- هذه الشروط مع سياسة الخصوصية هي الاتفاق الكامل بينك وبين بلسم بشأن الخدمة، ولمزوّدي الرعاية
يُكمّلها اتفاقُ الاشتراك أو العمولة المبرم معهم.
- إن عُدّ أيُّ بندٍ باطلاً أو غيرَ نافذ، بقيت سائر البنود نافذة.
- عدمُ تمسّكنا بحقٍّ أو تأخّرنا فيه لا يُعدّ تنازلاً عنه.
- لا يجوز لك نقل حسابك أو حقوقك بموجب هذه الشروط إلى غيرك، ويجوز لنا نقلها ضمن إعادة هيكلةٍ أو
انتقالٍ للخدمة مع إشعارك ودون إنقاصٍ لحقوقك.
- نراسلك داخل التطبيق أو برسالةٍ إلى رقمك المسجَّل، ويُعدّ ذلك إشعاراً لك.
- عند اختلاف النصّين العربيّ والإنجليزيّ يُعتمد النصّ العربيّ.
١٧. الترخيص عبر App Store
أطرافُ هذه الاتّفاقيّة: هذه الاتّفاقيّة بينك وبين
بلسم وحدَنا — وليست مع Apple. وبلسم وحدَه مسؤولٌ
عن التطبيق ومحتواه.
نطاقُ الترخيص: يُمنح ترخيصٌ شخصيٌّ غيرُ قابلٍ للنقل
لاستعمال التطبيق على أجهزة Apple التي تملكها أو تتحكّم بها، وفق قواعد
الاستعمال في شروط خدمات Apple.
الصيانةُ والدعم: بلسم وحدَه مسؤولٌ عن الصيانة
والدعم الفنّي، ولا تتحمّل Apple أيَّ التزامٍ بذلك.
الضمانُ والمطالبات: بلسم وحدَه مسؤولٌ عن أيّ ضمان،
وعن أيّ مطالبةٍ تتعلّق بالتطبيق — مسؤوليّةَ منتجٍ أو مخالفةَ نظامٍ أو
حمايةَ مستهلكٍ أو خصوصيّة. وإن لم يُطابق التطبيقُ ضمانَه، جاز لك إبلاغُ
Apple لتردَّ ثمنَ الشراء إن وُجد، ولا التزامَ عليها بعد ذلك.
الملكيّةُ الفكريّة: إن ادّعى طرفٌ ثالث أنّ التطبيق أو
استعمالك له ينتهك ملكيّته الفكريّة، تتولّى بلسم وحدَها — لا Apple —
التحقيقَ في الادّعاء والدفاعَ عنه وتسويتَه.
الامتثالُ القانونيّ: تُقرّ بأنّك لست في دولةٍ خاضعةٍ
لحظرٍ أمريكيّ، ولست مُدرجاً على قوائم الأطراف المحظورة.
شروطُ الأطراف الثالثة: عليك الالتزام بشروط الأطراف
الثالثة السارية عند استعمال التطبيق، كاتفاقك مع مزوّد خدمة الاتصالات أو الإنترنت.
المطوّرُ والتواصل: ينشر التطبيقَ في App Store مطوّرُه نيابةً عن
مالك خدمة بلسم، ومالكُ الخدمة مسؤولٌ عنها وعن محتواها، ويشمل لفظُ «بلسم» في هذا
القسم المطوّرَ الناشر. ويُوجَّه أيُّ سؤالٍ أو شكوى أو مطالبةٍ تتعلّق بالتطبيق إلى
support@balsam.online أو من داخل
التطبيق (حسابي ← الدعم والمساعدة).
طرفٌ ثالثٌ مستفيد: تُعدّ Apple وشركاتُها التابعة
أطرافاً ثالثةً مستفيدةً من هذه الاتّفاقيّة، ولها حقُّ إنفاذها تجاهك
بصفتها مستفيداً منها.
Terms of Service — Balsam

These terms are a binding agreement between you and Balsam (in these terms, “Balsam”, “we” and “us” mean the owner and operator of the Balsam service). By creating an
account or using the app or any of its systems, you agree to them and to the
Privacy Policy. If you do not agree, do not use the service.
1. Nature and limits of the service
Balsam is a technology platform that connects patients with licensed healthcare providers. It lets patients:
- Book clinic appointments and follow the queue.
- Request home care and nursing services from verified staff.
- Request laboratory tests at the lab or by home sample collection, and receive results.
- View the prescriptions their doctor writes, and have them dispensed in person at a
licensed pharmacy.
- Keep a health profile for themselves and their family, use informational health tools,
an emergency card, and message their provider.
It gives providers systems to run their work: a clinic system, a pharmacy system (point of
sale and stock) and a laboratory system.
Balsam is not a healthcare provider: it does not diagnose, prescribe or treat,
and it does not sell, dispense, deliver or charge for medicines. Medical care is provided by
licensed providers under their own professional and legal responsibility, and using Balsam creates no doctor–patient
relationship with Balsam. Balsam is not an emergency service — in an emergency, call an ambulance
immediately (122 in Iraq).
2. Eligibility and your account
- You must be 18 or older to create an account.
- You sign in with your phone number and a one-time code. You are responsible for your
phone and for keeping the code secret; our staff will never ask for it. Activity on your
account is attributed to you unless you report a breach immediately.
- The information you provide must be true and complete. Fake accounts, impersonation and
account sharing are prohibited.
- Doctor, pharmacy, laboratory and nursing accounts are activated only after their
documents and licence are verified, and are suspended if those are forged or expire.
3. Prescriptions and medicines
a. Issuing a prescription
- A prescription can be issued only by a licensed doctor from their Balsam
account, after examining the patient or based on a visit with them, under the doctor's
professional responsibility.
- The doctor alone decides the medicine, its form, dose, frequency, the
duration of treatment, directions for use, the prescription's validity, and how many times
and how often it may be dispensed.
- The system shows the doctor safety warnings (drug interactions, recorded allergies) as an
aid only; the clinical decision is the doctor's.
- Balsam does not write or change prescriptions and does not suggest medicines to patients.
b. Patient obligations
- Use the medicine exactly as your doctor directed, and do not change the
dose or duration without consulting them. Contact your doctor about any side effect.
- The prescription code (QR) is personal: show it only to the pharmacist dispensing it and
do not share it with anyone else.
- Altering or forging a prescription, trying to dispense it more times than the doctor
allowed, or dispensing it for someone other than the patient is prohibited. Any of these
leads to account suspension and may be reported to the competent authorities.
- Tell your doctor and pharmacist about your allergies and other medicines, and keep your
health profile up to date.
c. Dispensing
- Dispensing is in person only, at a licensed pharmacy registered in Balsam,
after the pharmacist scans the prescription code and verifies the identity of the patient or
the person accompanying them.
- The pharmacist may dispense all of a prescription or part of it depending on availability;
the rest can be dispensed at another pharmacy within the prescription's validity.
- The pharmacist may refuse to dispense if in doubt about the prescription or the patient's
identity, or if there is a medication risk. A prescription carrying a serious warning is
dispensed only with a written, logged reason.
- The price of the medicine is paid directly to the pharmacy; Balsam is not a party to the sale.
d. Controlled medicines
- They cannot be repeated, their prescription expires after 14 days, and they are dispensed
only together with a sale invoice and an entry in the pharmacy's controlled-substances
register (including the patient's name and ID number).
- Misusing or trafficking them is a crime punishable by law, and we cooperate with the
competent authorities on official request.
4. Laboratory tests and home sample collection
- The laboratory sets the available tests, their prices and home collection fees, which are
shown to you before you order.
- For home collection, a collector assigned by the laboratory visits you; their name and
number are shown to you. Hand over the sample and read out the confirmation code only to
the collector shown in your request.
- The confirmation code proves the sample was taken from you. Entering it wrongly repeatedly
cancels it and issues a new one.
- Cash you pay the collector is recorded in your request and counted in the laboratory's invoice.
- Results are the laboratory's responsibility and are verified by a qualified person there;
your doctor interprets them.
5. Bookings, home care and cancellation
- The cancellation and lateness policy shown at booking applies. A late cancellation may carry
a fee that is shown to you before you confirm it, and repeated no-shows may restrict your
future bookings.
- Clinic times are estimates; the actual queue at the clinic takes priority.
- For home care, the address must be correct and an adult must be present at the visit.
Assaulting or mistreating staff is prohibited.
6. Payments, discounts and points
- Services and medicines are paid directly to the provider (in cash). Balsam
collects no money from patients and stores no payment cards.
- Promo codes, loyalty points, rewards and wallet credit (granted only as compensation or a
reward, and never topped up with money) have no cash value, cannot be exchanged for money, may
be changed or withdrawn, and are forfeited if abused.
- Refunds and disputes over amounts are between you and the provider; our support team will
help resolve them.
- No purchase or payment is made inside the app: services are provided in person and paid directly
to the provider.
- Providers pay Balsam subscriptions or commissions as agreed with them, outside the app; these are
never charged to patients.
7. Conduct, messages and reviews
- Abusive, inciting or misleading content, spam, publishing other people's data without
their permission, and attempts to hack or automate the app are prohibited.
- Messages are for coordinating the service and are not a substitute for a medical examination.
- Reviews must reflect a real experience; fake or paid reviews are prohibited. Providers may
reply, and we remove anything that breaches these terms.
- You can report any abusive message or user, and we will take appropriate action.
8. Care provider obligations
- Keep a valid professional licence, provide genuine documents, and update them on renewal.
- Provide care according to professional standards and applicable law, and bear full
professional responsibility for any diagnosis, prescription or result you enter.
- Keep patient data confidential, use it only for their care, and do not copy or move it
outside Balsam except as the law requires.
- Do not share your account, and tell us immediately of any unauthorised use.
9. Pharmacies
- Provide a valid pharmacy licence; if it is forged, the account is closed and the matter is
referred to the competent authorities.
- Verify the prescription and the patient's identity before dispensing, follow what the doctor
prescribed, and apply the rules for controlled medicines.
- Keep the controlled-substances register as professional law requires. Balsam provides the
tool; legal responsibility lies with the licensed pharmacist.
- Issued invoices are not deleted but corrected with reversing entries. Credit balances are
between the pharmacy and its customer; Balsam is not a party to them.
- Do not use customer data for marketing outside the pharmacy without the customer's consent.
10. Laboratories and sample collectors
- The laboratory is responsible for test quality, the correctness and verification of results,
and the integrity of the sample from collection to analysis.
- The laboratory is responsible for choosing its collectors and their qualifications, and for
settling their accounts and fees.
- Collectors work in the field only, must verify the patient's identity with the confirmation
code, and must hand over to the laboratory any cash they collect.
11. Emergencies and health tools
- The SOS button sends your location and message to Balsam's support team so they can try to
help you. It does not replace calling an ambulance and does not guarantee help
within any particular time.
- Pregnancy tracking, children's vaccinations and the emergency card are organisational and
informational tools, not medical advice or diagnosis. Always consult a professional.
12. Intellectual property
The Balsam name and logo, the design of the app and website, and their software belong to
Balsam's owner. You are granted a personal, limited, non-exclusive, non-transferable licence to
use the app for its intended purposes. Copying, modifying, reverse-engineering the app or using
its trademark without written permission is prohibited.
13. Disclaimers and limitation of liability
- Not medical advice: information in the app — including medication safety
warnings, reminders and health tools — is for organisation and information only and does not
replace consulting a doctor. Consult your doctor before any medical decision, and never delay or
forgo seeking care because of something you read in the app.
- Responsibility for medical care, diagnosis, prescriptions, dispensing and test results lies
with the licensed providers.
- Independent providers: doctors, pharmacies, laboratories and nursing staff act
with professional independence and are not Balsam's employees or agents. Verifying their
documents at activation is not a guarantee of the quality, prices, availability or outcomes of
their services.
- “As is” and “as available”: we do our best to keep the service available and
accurate, without any express or implied warranty that it will be uninterrupted, error-free or
fit for a particular purpose, to the extent permitted by law.
- We are not responsible for third-party services you move to from the app (such as maps,
WhatsApp or phone calls), or for delayed or failed messages or notifications for reasons beyond
our control.
- Force majeure: we are not liable for any delay or failure caused by
circumstances beyond our reasonable control, such as disasters, power or public internet
outages, failures at hosting or telecom providers, and government decisions.
- To the extent permitted by law, we are not liable for indirect or consequential damages or
loss of profit.
- Indemnity: providers shall indemnify Balsam against any claim or damage arising
from their professional services or their breach of these terms or the law, and every user shall
do so for claims arising from their wilful breach of these terms, to the extent permitted by law.
- Nothing in these terms limits rights you have under consumer-protection law that cannot be
waived, or excludes anyone's liability for fraud or gross negligence.
14. Suspension and account deletion
- You can delete your account at any time in the app (My account → Delete account) or on the
account deletion page: it is frozen immediately and permanently deleted after
30 days unless you restore it by signing in and tapping “Restore my account”, as described in the Privacy Policy.
- We may suspend or restrict any account that breaches these terms or the law, or to protect
patients, and will tell the account holder why whenever possible.
15. Changes to these terms
We may change these terms. Material changes are announced in the app 30 days before they take
effect, and continuing to use the service after that means you accept them.
16. Governing law and general provisions
These terms are governed by the laws of the Republic of Iraq, and the courts of
Baghdad have jurisdiction over any dispute arising from them, without prejudice to your right to
approach the competent supervisory authorities.
- These terms and the Privacy Policy are the entire agreement between you and Balsam about the
service; for care providers they are supplemented by the subscription or commission agreement
made with them.
- If any provision is found invalid or unenforceable, the remaining provisions stay in effect.
- Our failure or delay in enforcing a right is not a waiver of it.
- You may not transfer your account or your rights under these terms to anyone else; we may
transfer ours as part of a restructuring or a transfer of the service, with notice to you and
without reducing your rights.
- We contact you in the app or by a message to your registered number, and that counts as notice
to you.
- If the Arabic and English versions differ, the Arabic version prevails.
17. App Store licence terms
Parties to this agreement: this agreement is between
you and Balsam only — not with Apple. Balsam alone is
responsible for the application and its content.
Scope of licence: you are granted a personal,
non-transferable licence to use the application on Apple-branded
products that you own or control, in accordance with the Usage Rules in
the Apple Media Services Terms.
Maintenance and support: Balsam alone is responsible
for maintenance and technical support; Apple has no obligation
whatsoever in that regard.
Warranty and claims: Balsam alone is responsible for
any warranty and for any claim relating to the application — product
liability, legal or regulatory non-compliance, consumer protection, or
privacy. If the application fails to conform to its warranty, you may
notify Apple, which will refund the purchase price if any; Apple has no
further obligation.
Intellectual property: if a third party claims that the
application or your use of it infringes their intellectual property,
Balsam alone — not Apple — is responsible for investigating, defending,
settling and discharging that claim.
Legal compliance: you represent that you are not
located in a country subject to a U.S. embargo, and that you are not
listed on any prohibited-parties list.
Third-party terms: you must comply with applicable
third-party terms when using the application, such as your agreement
with your mobile carrier or internet provider.
Developer and contact: the application is published on the
App Store by its developer on behalf of the owner of the Balsam service, who
is responsible for the service and its content; in this section, “Balsam”
includes that publishing developer. Direct any question, complaint or claim
about the application to
support@balsam.online or in the
app (My account → Help & support).
Third-party beneficiary: Apple and its subsidiaries are
third-party beneficiaries of this agreement and have the right to
enforce it against you as such.
